This document aims to provide a reference source and practical guidance on best practice in the management of highway liability risk exposures. In particular it considers how to apply the principles of risk management and a risk based approach to highway liability claims exposure.

The major insurers of local councils handle about 30,000 highway claims each year at a cost of around £40 million.  What we don’t have information on is the number and costs of the many thousands of claims that are handled in-house by the authorities themselves.  This will add significantly to these figures.  This podcast features an interview with Colette Dark, an independent insurance risk management expert at  KWD Associates who chaired the updated Highway Risk & Liability Guide 2017 (published in March 2017).

Problems can arise with some authorities where the procurement exercise has gone ahead to outsource the highways function and no thought was given during that procurement for what happens to the third party liability.
